01. How much does it cost to register my trademark in India?

The cost of trademark registration in India varies depending on the number of classes in which you want to protect your mark. Our professional fee for a single-class application is ₹1,999/- in addition to the govt fee. For individuals and Small Scale Industries, the govt fee is ₹4,500, and for Partnership Firms, Private limited Companies and other legal entities it is ₹9,000. There are no additional fees unless your application faces an objection, opposition etc.

02. Who can apply for trademark registration?

Trademark registration in India is open to both individuals and business organizations. You can apply for a trademark in your own name or in the name of your organization. Moreover, it's possible for two or more individuals to apply jointly for a trademark even without having a formal organization.

03. Why is trademark registration important?

Trademark registration is crucial because it grants you exclusive rights to take legal action against any entity that attempts to use your trademark without your permission. Registering your brand under a specific class doesn't automatically protect it from infringement in other classes.

04. Can a trademark application be amended?

Yes, amendments to a trademark application in India can be made by submitting a formal request to the Indian Trademark Registry. The applicant must use the designated form as specified in the Trade Marks Act of 1999. The designated form and the fee for a registered trademark will be different from an unregistered trademark.

05. What are some common reasons for trademark application rejection?

Trademark applications are commonly rejected if they share similarities with existing trademarks, contain geographical names, incorporate common words, have the potential to hurt religious sentiments, or are likely to cause confusion.

06. What if someone else has a similar word trademarked?

While you may not be able to secure the identical word as a trademark, there's still a path forward. You can opt to create a distinctive logo for your business that incorporates the name. So, there is a viable solution, but it's advisable to choose a unique name from the outset.

07. What is the typical timeframe for trademark registration?

The timeframe for trademark registration can vary. If there are no objections or opposition to your trademark application, it generally takes between 12 months to 18 months for registration. However, if there are objections, the process may extend to approximately 2-3 years. Nonetheless, we can initiate the application and begin using the ™ symbol within a few days if we receive all the necessary details and documents promptly.

08. Can you assure the approval of my trademark?

The approval of your trademark is subject to the government's discretion. However, if your trademark is unique, there is a strong likelihood that it will be granted.

09. When am I allowed to use the ™ symbol?

You can start using the ™ symbol as soon as you file the application and receive an acknowledgment. Once the registration process is finalized, you can then use the ® symbol.

10. What is the typical timeframe for applying for a new trademark?

The process of filing a trademark application usually takes one working day. This is after we have received all the necessary information, documents, and payment from you, and we have received approval from your end after reviewing the draft application we send.
